Appeals Court Allows Funding to Resume for Gateway Tunnel Project

The legal dispute continues over the pause of federal reimbursement.

The U.S. Court of Appeals for the Second Circuit declined to block a lower court order requiring President Trump’s administration to resume reimbursement payments for the Gateway Tunnel project that connects New York and New Jersey. The decision leaves in place a temporary restraining order issued by U.S. District Judge Jeannette Vargas, who ruled that the federal funding pause likely violated regulatory requirements.

The $16 billion project includes the construction of two new rail tunnels under the Hudson River and the rehabilitation of existing infrastructure. Federal transportation agencies had paused reimbursements pending regulatory review, prompting lawsuits from the Gateway Development Commission and the states of New York and New Jersey. The case centers on whether previously approved federal grants and agreements must continue during the review process.
